  • 1.1 What is your membership commitment?

    As a member, you can use our studio in line with these terms and conditions, including our studio Code of Conduct.

    1.2 How do you book classes?

    All members are required to pre-book classes to secure a spot in their desired class. All purchases and class bookings are made through our bookings partner Studio Bookings Online. Upon registration, you are entitled to one free trial week. You can book classes as soon as you have purchased a trial pass, membership plan or a casual class card. All purchases are non-refundable. Class passes can be transferred with written notice to hello@thestudiokiama.com.au.

    1.2 How do you book studio, gallery and co-working spaces?

    Studio hire, gallery hire and co-working are required to be pre-booked. You can book co-working spaces as soon as you have purchased a membership plan or a casual class card. Private studio hire enquiries should be directed to hello@thestudiokiama.com.au. Studio hire credits are available to purchase through our bookings partner Studio Bookings Online. Studio hire credits are non-refundable but are transferable with 14 days notice.

    1.3 Are there any discounts available?

    The Studio Kiama will, on occasion, provide discounts on memberships and class cards. The Studio Kiama provides discounted rates to public school students, First Nations people, front line healthcare workers, people who have recently immigrated to Australia and any members supported by the NDIS or pension. In order to receive the discount a valid identification is required at the time of membership enrollment. Please inquire with our staff via hello@thestudiokiama.com.au for more details on discounted memberships and class cards.

    1.4 How do contract memberships work?

    All contract memberships (Mini, Commit, Devote, Family and Co-Work) are recurring and billed weekly. This means they are auto-renewing so you get access until you decide to hit pause.

    Memberships will automatically renew each week at the same payment terms and billing date established at time of enrollment.

    Members can upgrade or downgrade their membership at any time without penalty.

    Members can put their membership on freeze at any time for up to ninety (90) days per calendar year. Members will not be billed for frozen weeks, and billing will resume automatically upon the end of the freeze period.

    Any changes to memberships, or cancellations must be received 14 days in advance.

    1.5 How do class cards work?

    All class cards (Casual, Private, and Co-Work Casual) are paid upfront and do not automatically renew upon expiration.

    Class cards cannot be refunded.

    1.6 How do memberships work?

    We will debit your weekly membership fees from your nominated account from the day you purchase your membership.

    1.7 What happens if your payment is late or fails?

    If you do not fully pay your fees on the due date, we will suspend your studio access until your payments are up to date and you have provided correct account details. You will also be charged a late payment fee of $10.00 for any failed payments. This will be debited from your account.

  • 2.1 What happens if a class is full?

    All classes are capped at 6 to 10 members. If the class cap is reached then your name will be added to a waitlist. If you are on the waitlist you will need to wait until a spot opens to attend the class. The system will notify you directly if space becomes available.

    2.2 What if you need to cancel a class?

    If you have pre-booked a class and can no longer attend, you will be required to cancel your booking 2 hours prior to the class start time.

    If you cancel your booking within 2 hours of the class start time or after the class has started, one of your class credits will be used.

    2.3 What happens if you forget to cancel your class?

    If you do not show up to a class, you will be marked off as a no-show and lose that class credit.

    2.4 Can we change your agreement?

    We may sometimes add to, change or remove our terms and conditions. This includes changing the studio's opening and closing hours, its services and facilities and membership fees. You can find copies of our current terms and conditions at the studio or on our website at www.thestudiokiama.com.au/terms-conditions. We will give you at least 14 days notice of any changes, for instance by publishing them in our newsletter or on our website, placing a notice in the studio, phoning you or writing to the address (post or email) you last gave us.

    2.5 Can we increase your fees?

    Your membership fees will only increase if we provide you with at least 28 days beforehand by writing to the email address you last gave us. We will consider you to have received our email on the second business day after it is sent.

    2.6 What about your health?

    On the day you sign your agreement and each time you use our studio, you promise us that you are in good physical condition, unless you have otherwise advised us in writing. If you have any doubts, we suggest you seek expert medical advice before participating in class. If you have any conditions that impact your participation in class or any concerns about your ability to participate in class, please tell your class teacher or email hello@thestudiokiama.com.au

    2.7 What about your safety?

    Your safety in our studio is our highest priority. We reserve the right to scale or stop any class or any member's participation in class if it is deemed unsafe.

    The Studio Kiama reserves the right to refuse service to anyone for any reason. We reserve the right to cancel a member’s membership at any time for any reason. If your membership is terminated by The Studio Kiama for any reason; we will refund the balance or remainder of any prepaid, unused membership.

    COVID-19 SAFETY CLAUSE

    By attending The Studio Kiama, you acknowledge that we are in a COVID-19 pandemic and that you are choosing to attend out of your own free will, knowing we are in a pandemic. In doing so, you waive The Studio Kiama, its associates and employees from any liability of sickness or illness due to contracting COVID-19, or any other pandemic related illness or injury. You also acknowledge that you are following and abiding by the Government's advice, rules and regulations in relation to COVID-19. By attending the studio, you understand the contents of this clause and are aware that it is legally binding.

  • 3.1 Can you cancel your membership?

    All memberships can be canceled at any time. You can cancel your membership by giving written notice of your cancellation request via email to hello@thestudiokiama.com.au. All cancellation requests must be received 14 days in advance.

    If you choose to cancel your membership at any time and return at a later date you will be subject to any rate increases at the time of enrollment.

  • 4.1 Your responsibilities

    Your responsibilities, including payment of membership fees, do not depend on how often you use the studio. You must tell us about anything that affects your membership, and any changes to your contact and bank details.

    Your responsibilities include making sure:

    Your account can accept direct debits

    There is enough money in your account on the payment day and the next 5 days

    You tell us if you are transferring or closing your account, at least 3 business before your next direct debit

    You tell us about any changes to your credit card, such as its expiry date or number, at least 3 business before your next direct debit

    You are aware of your membership expiration and renewal dates.

    4.2 Privacy policy

    During your membership, we will have access to personal information about you, such as about your health and financial situation. We will only use, disclose or deal with your information in line with our Privacy Policy, which is available on our website at www.thestudiokiama.com.au/privacy-policy. This Privacy Policy applies to the services offered by The Studio Kiama Pty Ltd (ABN 36 652 518 566) (The Studio Kiama).

    The Studio Kiama is committed to protecting your privacy and any personal information we collect. The Studio Kiama complies with the Privacy Act 1988 (Cth). This policy explains how we may collect, use, disclose and otherwise handle personal and sensitive information. The Studio Kiama is committed to safeguarding personal privacy. It recognises that individuals have a right to control how their personal information is collected and used. Providing personal information is an act of trust and it is taken seriously. For the purposes of this Privacy Policy personal information may mean some or all of the following: A member’s name, contact details, date of birth, emergency contact details, bank account and/or credit card details, member identification details, payment history and sensitive information.

    4.3 Links to other websites

    The Studio Kiama provides links to websites outside of the The Studio Kiama site. These linked sites are not under the control of The Studio Kiama, and The Studio Kiama is not responsible for the conduct of companies linked to the The Studio Kiama web site, nor for the performance or otherwise of any content and/or software contained in such external websites.
